Well, I have one question about an user called "myrem"
I supossed he/she is from the Myrem forum known for its FTP. Well, I was checking the content of the FTP last week and i found some shows (in mp3 of course) torrented here in flac like Lisbon and Barcelona. I think I specify too cleary to not convert the songs onto mp3 in the threads and in the TXT attached.
All we know how popular is the FTP and I think isn't good that people are getting the shows in mp3 and don't follow the rules of the tapers :mad:
What do you think?

I think we all hate the mp3 trading but theres not much we can do about it. As far as the posts here we like to see source info and are often critical on the files, try to make sure it is in fact the best known available source. It's pretty much the best we can do...

I appologise for listing the DVD on EBay, I did not read the rules regarding bootlegs and I was not sensitive to the Murmurs community's stance on the selling of such bootleg material on EBay. I also didn't realise EBay had a anti-bootleg rule until I read their policy pages.
I will not be relisting the REM Vienna DVD.
I read the part about me potentially listing the recording of the Melbourne concert. This will NOT happen. I have fond memories of this - my first REM gig - and I was on holiday in Australia at the time - this bootleg recording will be sent on CD as a gift for my friend in Australia, as we went to the concert together while I was in Melbourne. Also another thing from the thread I need to set straight - someone mentioned I had sold REM tickets on EBay - this is untrue, if you look at the feedback and auction page you will see that I bought REM tickets for both the Melbourne gig and the Manchester gig (which I went to on June 17th) on EBay at a good price.
I am a genuine REM fan, and have visited Murmurs almost daily since 1996 when I was at college and first had access to the Internet. I became a web designer due in part to great sites like Murmurs, so this situation I am in, I find very hurtful. This is why I'm sending you both this email, not to request to be unbanned, but just to appologise and to offer a gesture of peace to you all. I can't say how sorry I am about this. However my crime is a victimless one - it has not harmed anyone financially, the customers are all happy with the DVD and happy to pay for it rather than download a massive 4GB torrent. Murmurs remains free, but not everyone has the knowledge, patience or bandwidth to download from the torrent. Therefore the service I was offering on EBay I offered in good faith, and it has made a few REM fans very happy. I am sorry if I offended you though and I should have been more aware of the rules - and it is due to the upset I have caused you all on Murmurs.com that I will not relist the item.

I appreciate the message, bottom line is he could have listed then for a dollar, or posted here that he was willing to send them to anyone for a few bucks or B+P. I still think it is unacceptable. Here it is to share if any other mods want to say anything about it.

I haven't answered Commander Spike's email and I have no desire to answer it. He was sorry because he was caught. That's about it. I have no tolerance for scumbags like these. Pardon my language but this is how I feel and I'm a very agreeable person. It takes alot to make me get mad. Getting money out of fans who don't know otherwise is just plain rude and heartless.
This what's gets to me, so now he is being a samaritan by selling it?!? WTF, has this guy never heard of Trees, Vines, B+P and trade? Please..... :rolleyes:

I don't think myrem has any connection with the people on Myrem.com but I could be wrong though. Have you contacted Patrick/Jim about it?

i am sure he is hurt that he got banned.
whether he contributed much or nothing he surely visited the site often.
anyway i agree that he is no samaritan by selling boots.
decision stands and i will check the ip adresses every now and then to see whether he has returned or not.

But IPs are dinamic and he could register again with another nickname.
the FTP thing: I don't know Jim. I'm a casual user of myrem forum and don't have contact with the managment.

i registered all ips that commanderspike has ever benn online with. all these ips were exclusively his. so since he is a long time murmurs user the probability is very high that if a new user with (at least) one of the same ips would register soon here that it is him.

Well, Maybe I'm wrong but, the first number of an IP is from the ISP you are conected isn't it?. There are a lot of ways to changue that, conected to a different DNS or from another computer (work, home, girlfriend...).
I have a similar problem with a nasty user in my REM spanish forum, i thought to ban his IP but it's very difficult to apreciate; the last numbers changue everytime you disconected the modem/router. So he could get another IP doing this (similar first number for the ISP and different last ones). If you banned all IPs that have this first numbers you will ban all users from this ISP!! and maybe it could be another person. Do you understand me?
Same happened in the old GIA-Winmx when Nicol and me banned bad users IPs.
Anyway, if you are going to check the new IPs, you'll have a lot of work but hope it will be useful :)

i am very aware of that problem. :)
but in the admin panel there is the possibility to do a subnet check (subnet = part of a full ip adress). so you can check what users connect vie the same subnet.
such a search is always done before banning a whole subnet. i didnt do a subnet ban for commanderspike since he connected from quite a few (about 8) different ips and about 3 different subnets.
on winmx you could (depending on rights) also ban a whole subnet but there was no easy way to find out who connected from that subnet .
there are people having static ips, especially ones that have a cable connection.
also i banned a few subnets already on murmurs who were mostly spammers and it was sure that that subnet was unique to those users (according to the admin panel).
so how i will check if he signs up with a new account will be the following:
search for all users with the same ipadress as commanderspike (as for now there are none). also check the subnets and see whether there are any. since there are none right now we can still be quite sure it is him especially when it is a newly registered user. third thing also might be if he uses the same email adress.

anyway, the owner/hoster of the myrem FTP should know the user who uploaded the murmurs shows so we could ask him.

I have met him at Red Rocks in 2003 together with the other hosts there. He's a very nice guy, I could try and ask him but I can't be sure if he will acquiesce.
Actually on second thought I'd better not contact him as I'm not the taper. I think the whoever is the taper will have more rights to ask him about it. Don't you think?

Commander Spike's ban is perfect with me. The only argument he was denying by not talking about it is the fact that he is MAKING MONEY with 'our stuff'. The argument about 4Gb downloads and helping people out is a bullshit argument. If he's been around since 1996 he should know about our moral standards on trading and exchanging music and bootlegs.
The conversion to MP3 of shows hosted on murmurs is another thing. It has been a decade long discussion in bootleg communities and will never stop. It is my opinion that once it is out there the poster looses control of the format. We can't control what happens from there. What can we do when it is posted on usenet in MP3 format or on a website?
Maybe we can make some arrangements with myrem FTP but on the other hand the fact that they allow MP3's is the main attraction to a lot of their members.
The discussion should be on the question if the taper rules on the format of the show against the fact that once you posted it you loose control of the format. Their is no copyright law on bootlegging so we don't have any enforcement mechanisms on our hands expect to keep requesting people not to convert the shows to lossy formats.
We as a public board can only force the use of lossless formats on our own board, but our responsibilities on the format end after the user has downloaded. That should be our message to the users of murmurs and our policy. If a taper wants to protect the format of their recording they should not post on murmurs because we can't control what happens after downloading, and we shouldn't want to control it becuase of the arguments mentioned above.

You are 100% correct about the mp3s arguement and that's why I don't want to contact them. We can only monitor the postings of mp3s here but other than that we can't really do something. There will always be people who wants to download mp3s because they are easy to understand and pretty fast to get. What we can only ask them probably is maybe put a note that mp3s should only be used for personal use and not to be traded. And, if they wanted a lossless files to refer them to Murmurs.com or to REM-collector.com.

i like mp3 but at least i know what to do (or better not do) with them.
